These Website Terms of Use (“Terms”) govern your access to and use of the Piscys website, including piscys.ai and any publicly available content, resources, and communications made available through it (collectively, the “Site”).

By accessing or using the Site, you agree to these Terms. If you do not agree to these Terms, please do not use the Site.

These Terms apply to use of the Site only. Paid advisory services, design-partner engagements, platform access, and other commercial relationships with Piscys may be governed by separate written agreements.

1. Who We Are

The Site is operated by Piscys, Inc. (“Piscys,” “we,” “us,” or “our”).

2. Changes to These Terms

We may update these Terms from time to time. The “Last Updated” date above identifies the effective date of the current version.Your continued use of the Site after revised Terms become effective constitutes acceptance of the revised Terms. Where required by applicable law, we may provide additional notice of material changes.

3. Privacy

Your use of the Site is also governed by our Privacy Policy and Cookie Notice, which describe how we collect, use, disclose, and otherwise process personal information and how cookies and similar technologies may be used.

4. Permitted Use and Acceptable Use

You may use the Site for lawful informational, business, and evaluation purposes consistent with these Terms.

You agree not to:

• Use the Site in violation of applicable law or regulation.
• Attempt to gain unauthorized access to the Site, systems, accounts, networks, or data.
• Interfere with, disrupt, disable, or degrade the operation or security of the Site.
• Introduce malicious code, malware, or other harmful material.
• Conduct unauthorized vulnerability scanning, penetration testing, denial-of-service testing, or similar security activity.
• Use automated means to access the Site in a manner that circumvents technical controls or imposes an unreasonable load on Site infrastructure.
• Impersonate another person or entity or misrepresent your affiliation with Piscys.
• Use Site content in a manner that infringes intellectual-property or other rights.

We may suspend or block access to the Site for conduct we reasonably believe violates these Terms. 

Good-faith security research should be conducted in accordance with our Security and Responsible Disclosure guidance.

5. Newsletter and Communications

If you subscribe to Piscys newsletters, updates, or other communications, you authorize us to send the communications you request.

You may unsubscribe from marketing communications at any time using the unsubscribe mechanism provided in the message or by contacting us directly. We may continue to send non-marketing communications where appropriate, including responses to inquiries and administrative or transactional notices.

6. Early-Stage Product Information; No Reliance

The Site may describe products, platform capabilities, features, demonstrations, technical concepts, architectures, research, roadmaps, pricing concepts, or other functionality that is under development, illustrative, experimental, planned, or subject to change.

Unless expressly stated otherwise in a binding written agreement, such descriptions are provided for informational purposes only and do not constitute a commitment, warranty, representation, offer, or guarantee regarding functionality, availability, performance, pricing, delivery dates, certification, regulatory status, or future development.

Prospective customers, partners, investors, and other parties should not rely on Site content as a substitute for the terms of a separate written agreement with Piscys.

7. No Professional Advice 

Content available through the Site is provided for general informational purposes and does not, by itself, constitute legal, regulatory, compliance, cybersecurity, financial, investment, medical, or other professional advice.

Any professional or advisory services provided by Piscys are governed by the applicable written engagement agreement.

References to laws, regulations, standards, or frameworks—including AI governance and risk-management frameworks—do not constitute legal advice, certification, or a representation that use of Piscys products or services will independently satisfy any particular legal or regulatory requirement.

8. Intellectual Property

The Site and its content—including text, graphics, logos, product names, designs, software concepts, illustrations, demonstrations, documentation, and other materials—are owned by Piscys or its licensors and are protected by applicable intellectual-property laws.

Subject to these Terms, Piscys grants you a limited, non-exclusive, non-transferable, revocable right to access and use the Site for lawful personal or internal business purposes.

Nothing in these Terms grants any license or right to Piscys patents, patent applications, trademarks, trade secrets, proprietary technology, or other intellectual property except as expressly stated.

Third-party names, trademarks, and materials remain the property of their respective owners.

9. Feedback

If you provide comments, ideas, suggestions, or other feedback regarding Piscys, the Site, or our products or services (“Feedback”), you grant Piscys a worldwide, perpetual, irrevocable, royalty-free right to use, reproduce, modify, incorporate, and otherwise use that Feedback without restriction or compensation.

Please do not provide confidential or proprietary information as Feedback unless it is covered by a separate written confidentiality agreement.

10. Third-Party Links and Services

The Site may contain links to third-party websites, services, content, or resources. Piscys does not control and is not responsible for third-party content, availability, security, privacy practices, or terms.

Access to third-party resources is at your own discretion and may be subject to separate terms and policies.

11. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY.

PISCYS DISCLAIMS, TO THE MAXIMUM EXTENT PERMITTED BY LAW, IMPLIED WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

Piscys does not warrant that the Site will be uninterrupted, error-free, secure, or free of harmful components.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PISCYS AND ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, AND AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATING TO YOUR ACCESS TO OR USE OF THE SITE.

Some jurisdictions do not permit certain exclusions or limitations of liability. In those jurisdictions, the applicable limitations will apply only to the extent permitted by law.

13. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Piscys and its directors, officers, employees, and agents from claims, losses, liabilities, damages, and reasonable costs arising from:

• Your unlawful or unauthorized use of the Site;
• Your material violation of these Terms; or
• Your infringement or violation of another party’s rights.

14. Confidentiality and Restricted

Certain information or materials may be made available by Piscys on a restricted-access basis, including investor, partner, customer, design-partner, or data-room materials.

Where those materials are subject to a separate confidentiality agreement, nondisclosure agreement, data-room terms, or other written restrictions, those separate terms govern.

Nothing in these Website Terms independently creates a confidential relationship unless expressly stated.

15. Governing Law and Venue

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles.

Subject to any mandatory rights available under applicable law, any dispute arising from these Terms or use of the Site will be brought in the state or federal courts located in San Francisco County, California, and you consent to the jurisdiction and venue of those courts.

16. Severability and Entire Agreement

If any provision of these Terms is determined to be invalid or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in effect.

These Terms, together with the Privacy Policy and Cookie Notice, constitute the agreement between you and Piscys regarding your use of the Site, except where a separate written agreement expressly governs.
